I. The above-entitled application was filed on Oe~ember(~_..-
30, 1977, and was referred to the water referee for Water Di~i-
sian 5 on January 13. 1978. ,

2. The rul iny of the referee was entered on October 7.

3. The referee's ruling was timely protested by objector
Brush (reek t Eagle River Company. Nei ther appl icant nor any
other objeCtor fi led a protest to the rut ing.

4. On Jul y 18. 1985. a pretrial conference was held. at
which time protestor's attorney moved to withdraw and trial was
set.

5. On July 25. 1985. a notice of trial date was sent by
counsel for the appl icant to the protestor at its last known
address, advising that trial had been set for September 5, 1985
