The natural stream channel from headwaters in the vicinity of latitude , 38008' 36" N and longitude 1070 11' 42" W as the upstream terminus and extending to Johnson Ditch Headgate in, NW 1/4 NE 1/4 Sec. 19, T46N, R3W, NMPM as the downstream terminus, being a. distance of approximately 7.9 miles. This segment can be located on the Powderhom Lakes U.S.G.S. quadrangle. See Exhibit A. 5. Use of water: To preserve the natUral environment to a reasonable degree. 6. Date of initiation of appropriation: May 11,1998. 7. The water was first applied to the above beneficial use on May 11, 1998, by action of the Colorado Water Conservation Board under the provision ofC.R.S. ~ ~ 37-92-102(3),37-92-103(3), (4), (10). 8. Amount of water claimed (ABSOLUTE): Instream flow of 1.25 c.f.s. (May 1 - October 31); 0.75 c.f.s. (November 1 - April 30). THE WATER REFEREE RULES: The application is granted and a decree in the amount of (ABSOLUTE) Instream flow of 1.25 c.f.s. (May 1 - October 31); 0.75 d.s. (November I - April 30) is hereby entered to preserve the natural environment to areasonable degree through the upstream and downstream points as described in paragraph 4 above. The appropriation date for this water right is May 11, 1998. The priority herein awarded was filed in the water court in the year of 1998 and shaIl be junior to all priorities filed in previous years. As between all rights filed in the same calendar year, priorities shaIl be determined by historical date of appropriation and not affected by the date of entry of ruling. The Applicant shaIl instaIl and maintain such measuring devices and keep such records as the Division Engineer may require for administration of this right. , It is ORDERED that this Ruling shaIl be tiled with the water clerk subject to judicial review. It is ORDERED that a copy of this Ruling shaIl be filed with the Division Engineer and the State Engineer. 2
