<br />I <br /> <br />No 98CW223 <br />Colorado Water Cons. Board <br /> <br />a. The natural stream channel from headwaters in the vicinity of latitude <br />, <br />38008' 36" N and longitude 1070 11' 42" W as the upstream terminus and <br />extending to Johnson Ditch Headgate in, NW 1/4 NE 1/4 Sec. 19, T46N, <br />R3W, NMPM as the downstream terminus, being a. distance of <br />approximately 7.9 miles. This segment can be located on the Powderhom <br />Lakes U.S.G.S. quadrangle. See Exhibit A. <br /> <br />5. Use of water: <br /> <br />To preserve the natUral environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />May 11,1998. <br /> <br />7. The water was first applied to the above beneficial use on May 11, 1998, <br />by action of the Colorado Water Conservation Board under the provision <br />ofC.R.S. ~ ~ 37-92-102(3),37-92-103(3), (4), (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 1.25 c.f.s. <br />(May 1 - October 31); 0.75 c.f.s. (November 1 - April 30). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree in the amount of (ABSOLUTE) <br />Instream flow of 1.25 c.f.s. (May 1 - October 31); 0.75 d.s. (November I - April 30) <br />is hereby entered to preserve the natural environment to areasonable degree through <br />the upstream and downstream points as described in paragraph 4 above. The <br />appropriation date for this water right is May 11, 1998. <br /> <br />The priority herein awarded was filed in the water court in the year of 1998 <br />and shaIl be junior to all priorities filed in previous years. As between all rights filed <br />in the same calendar year, priorities shaIl be determined by historical date of <br />appropriation and not affected by the date of entry of ruling. The Applicant shaIl <br />instaIl and maintain such measuring devices and keep such records as the Division <br />Engineer may require for administration of this right. <br /> <br />, <br /> <br />It is ORDERED that this Ruling shaIl be tiled with the water clerk subject to judicial <br />review. <br /> <br />It is ORDERED that a copy of this Ruling shaIl be filed with the Division Engineer <br />and the State Engineer. <br /> <br />2 <br />
