7. Thi5 appropriatto~ is made pursuant to C.R.S.
1973. 37-92~I02(3) .~n~37-92-103(3) and (4)- The purpose
of this ~ppropr!ation by the State of Colorado is to insure
the preserv~tion of a mi~imum stream level to protect the
natural environment to a reasonable degree.

8. The appl icantt by stipu1ationt does not acknowl-
edge at this time any rights to water by the United States
of America, but in the future if the United States of America
shall seek appropriate judicial determination of any claimed
water rights in the watershed involved herein, the app1 icant
stipulates and agrees that its right shall be subject to
any adjudicated senior right of the United States of America.

9. The priority herein awarded said Middle St.
Vrain Creek was filed in the water court in the year of
1978 and shall be administered as having been filed in that
yeari and shall be junior to all priorities fi1~d in previous
years. As between all rightst filed in the same calendar
year, priorities shall be determined by historical dates of
appropriation and not affected by the date of entry of rul ing.
