Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from the outlet of <br />Kiplinger Lake at latitude 40014'28"N and <br />longitude 105037'58"W as the upstream termi- <br />nus and extending to the confluence of North <br />St. vrain Creek in the NE/4 SE/4, Sec. 21, <br />T3N, R73W, 6th P.M. as the downstream termi- <br />nus, being a distance of approximately 4.6 <br />miles. This segment can be located on the <br />AlIens Park and Isolation Peak U.S.G.S. quad- <br />rangles and is depicted on Exhibit A. <br /> <br />For the stream segments in an unsurveyed <br />area, the Division Engineer has determined <br />for administrative purposes that the approxi- <br />mate legal description of the instream flow <br />termini as protracted from U.S.G.S. and/or <br />U.S.F.S. mapping is as follows: upstream <br />terminus in the SW/4 NE/4, Sec. 12, T3N, <br />R74W, 6th P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />July 24, 1995. <br /> <br />7. The water was first applied to the above beneficial use <br />on July 24, 1995, by action of the Colorado Water Conservation <br />Board under the provision of C.R.S. ~~ 37-92-102(3), <br />37-92-103 (3), (4), (10) . <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of <br />3.50 c.t.s. (May 1 - Sept. 15); 1.50 c.f.s. (Sept. 16 - Nov. 15); <br />0.75 c.f.s. (Nov. 16 - March 31); 1.50 c.f.s. (April 1 - April <br />30) . <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the <br />amount of 3.50 c.f.s. (May 1 - Sept. 15); 1.50 c.f.s.
