4. Legal description of the stream segment through which
an instream flow is claimed.

The natural stream channel from the outlet of
Kiplinger Lake at latitude 40014'28"N and
longitude 105037'58"W as the upstream termi-
nus and extending to the confluence of North
St. vrain Creek in the NE/4 SE/4, Sec. 21,
T3N, R73W, 6th P.M. as the downstream termi-
nus, being a distance of approximately 4.6
miles. This segment can be located on the
AlIens Park and Isolation Peak U.S.G.S. quad-
rangles and is depicted on Exhibit A.

For the stream segments in an unsurveyed
area, the Division Engineer has determined
for administrative purposes that the approxi-
mate legal description of the instream flow
termini as protracted from U.S.G.S. and/or
U.S.F.S. mapping is as follows: upstream
terminus in the SW/4 NE/4, Sec. 12, T3N,
R74W, 6th P.M.

5. Use of the water:

Instream flow to preserve the natural environment to a
reasonable degree.

6. Date of initiation of appropriation:

July 24, 1995.

7. The water was first applied to the above beneficial use
on July 24, 1995, by action of the Colorado Water Conservation
Board under the provision of C.R.S. ~~ 37-92-102(3),
37-92-103 (3), (4), (10) .

8. Amount of water claimed (ABSOLUTE): Instream flow of
3.50 c.t.s. (May 1 - Sept. 15); 1.50 c.f.s. (Sept. 16 - Nov. 15);
0.75 c.f.s. (Nov. 16 - March 31); 1.50 c.f.s. (April 1 - April
30) .

THE WATER REFEREE RULES:

The application is granted and a decree (ABSOLUTE) in the
amount of 3.50 c.f.s. (May 1 - Sept. 15); 1.50 c.f.s. (Sept. 16 -
Nov. ,15); 0.75 c.f.s. (Nov. 16 - March 31); 1.50 c.f.s. (April 1
- April 30) is hereby entered to preserve the natural environment
