3. The source of the water is:

Big Spring Creek, tributary to the Closed Basin.

4. Legal description of the stream segment through which
an instream flow is claimed.

The natural stream channel from the headgate
of Los Ojos Ditch in the vicinity of latitude
37044'07"N and longitude 105040'04"W as the upstream
terminus and extending to the inlet of San Luis Lake
at latitude 37040'56"N and longitude 105043'43"W being
a distance of approximately 6.85 miles. This segment
can be located on the Medano Ranch U.S.G.S. quadrangle.

For the stream segments in an unsurveyed area, the
Division Engineer has determined for administrative
purposes that the approximate legal description of the
instream flow termini as protracted from U.S.G.S.
and/or U.S.F.S mapping is as follows: upstream termi-
nus in the NE/4 NW/4, Sec. 9, T40N, R12E, N.M.P.M.;
downstream terminus in the SE/4 NE/4 SE/4, Sec. 26,
T40N, RIlE, N.M.P.M.

5. Use of the water:

Instream flow to preserve the natural environment to a
reasonable degree.

6. Date of initiation of appropriation:

November 3, 1994.

7. The water was first applied to the above beneficial use
on November 3, 1994, by action of the Colorado Water Conservation
Board under the provisions of C.R.S. (1990) ~~ 37-92-102(3),
37- 92 -103 (3), (4), and (10).

8. Amount of water claimed (ABSOLUTE)
0.25 c.f.s.

THE WATER REFEREE RULES:

The application is granted and a decree (ABSOLUTE) in the
amount of 0.25 c.f.s. is entered to preserve the natural environ-
ment to a reasonable degree through the upstream and downstream
points as described in paragraph 4 above. The appropriation date
for this water right is November 3, 1994.
