<br />" <br /> <br />. <br /> <br />. <br /> <br />ii) The Conejos District agrees to bypass 40 cfs. <br />of the natural inflow into Platoro Reservoir during the <br />period from May 1 through September 30 to protect the <br />natural environment below the reservoir to a reasonable <br />degree; however, this provision shall not be construed <br />to require the Conejos District to release water <br />previously stored so as to provide for the 40 cfs. <br />flow. If the natural inflow into Platoro Reservoir is <br />less than 40 cfs. then the bypass will be limited to <br />the amount of the actual natural flow into Platoro <br />Reservoir. <br /> <br />iii). The Conejos District shall comply with all <br />applicable legal requirements and obtain any applicable <br />approvals necessary to implement such changes or <br />exchanges of water rights. <br /> <br />b. The Conservation Board recognizes that the Conser- <br />vation Board water rights are junior to the water rights of <br />the Conejos District adjudicated in Case No. W-3253, <br />District Court, Water Division No.3, with an appropriation <br />date of June 1, 1905, by decree dated November 25, 1985. <br /> <br />3. <br />principle <br />stream. <br /> <br />This stipulation and Agreement establishes no general <br />or precedent with respect to any other interstate <br /> <br />4. This Stipulation and Agreement is not intended to limit <br />any other lawful uses which the Conejos District or its consti- <br />tuents might otherwise be entitled to make with regard to their <br />water rights. <br /> <br />5. The Conservation Board does not waive its right to <br />object to any present or future uses of water rights, or changes <br />of water rights, not in accordance with this stipulation. <br /> <br />6. By entering this Stipulation, the Conejos District <br />agrees not to oppose the said Conservation Board water rights <br />listed on Appendix A so long as this Stipulation is incorporated <br />by reference in any decrees entered therein. <br /> <br />7. This stipulation and Agreement shall be binding upon <br />and inure to the benefit of the successors and assigns of the <br />parties hereto. <br /> <br />-2- <br />
