" . . ii) The Conejos District agrees to bypass 40 cfs. of the natural inflow into Platoro Reservoir during the period from May 1 through September 30 to protect the natural environment below the reservoir to a reasonable degree; however, this provision shall not be construed to require the Conejos District to release water previously stored so as to provide for the 40 cfs. flow. If the natural inflow into Platoro Reservoir is less than 40 cfs. then the bypass will be limited to the amount of the actual natural flow into Platoro Reservoir. iii). The Conejos District shall comply with all applicable legal requirements and obtain any applicable approvals necessary to implement such changes or exchanges of water rights. b. The Conservation Board recognizes that the Conser- vation Board water rights are junior to the water rights of the Conejos District adjudicated in Case No. W-3253, District Court, Water Division No.3, with an appropriation date of June 1, 1905, by decree dated November 25, 1985. 3. principle stream. By entering this Stipulation, the Conejos District agrees not to oppose the said Conservation Board water rights listed on Appendix A so long as this Stipulation is incorporated by reference in any decrees entered therein. 7. This stipulation and Agreement shall be binding upon and inure to the benefit of the successors and assigns of the parties hereto. -2-
