<br />3. The source ofthe water is: West Fork Dry Creek <br /> <br />4. Legal description of the stream segment through which an instream flow is claimed <br /> <br />a. The natural stream channel from the confluence of Gray's Creek at <br />latitude 380 22' 37" N and longitude 1080 08' 47" Was the upstream <br />terminus and extending to the confluence of East Fork Dry Creek at <br />latitude 380 26' 13" N and longitude 1080 05' 01" W as the <br />downstream terminus, being a distance of approximately 5.9 miles. <br />This segment can be located on the Dry Creek Basin U.S.G.S. <br />quadrangles. <br />b. For administrative purposes only: <br />Upper Terminus = NW NW S36 T48N R12W NMPM <br />1100' East of West Section Line 9]0' South of North Section Line <br />UTM 4252316 N 225155 E Zone 13 <br />Lower Terminus = NW NE S9 T48N Rll W NMPM <br />2170' East of West Section Line 350' South of North Section Line <br />UTM 4258788 N 230861 E Zone 13 <br /> <br />5. Use ofthe water: <br />Instream floW to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 25, 2005. <br /> <br />7. The water was first applied to the above beneficial use on January 25, 2005, <br />by the action of the Colorado Water Conservation Board under the provisions of c.R.S. <br />9937-92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): lnstream flow of 0.85 cfs (Mar. I <br />_ Mar. 31), 3.4 cfs (Apr. 1 - June 14),0.85 cfs (June 15 - July 31), and 0.3 cfs (Aug. 1 - <br />Feb. 28). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 0.85 cfs <br />(Mar. I - Mar. 31), 3.4 cfs (Apr. I - June 14),0.85 cfs (June 15 - July 31), and 0.3 cfs <br />(Aug. 1 - Feb. 28) is hereby entered to preserve the natural environment to a reasonable <br />degree through the stream segment described in paragraph 4 above. The appropriation <br />date for this water right is January 25, 2005. <br /> <br />The priority herein awarded was filed in the water court in the year of 2005 and <br />shall be junior to all priorities filed in previous years. As between all rights filed in the <br />same calendar year, priorities shall be determined by historical date of appropriation and <br />not affected by the date of entry of ruling.
