The source of the water is: <br /> <br />South Clear Creek, tributary to Clear Creek, a ,tribu- <br />tary to the Rio Grande, <br /> <br />4. Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from the outlet of <br />Lower Hermit Lake at latitude 37048'28"N and <br />longitude 107013'14"W as the upstream termi- <br />nus and extending to the inlet of Upper Brown <br />Lake at latitude 37049'04"N and longitude <br />107012'15"W as the downstream terminus, being <br />a distance of approximately 1.3 miles. This <br />segment can be located on the Hermit Lakes <br />U.S.G.S. quadrangle. <br /> <br />For the stream segments in an unsurveyed <br />area, the Division Engineer has determined <br />for administrative purposes that the approxi- <br />mate legal description of the instream flow <br />termini as protracted from U,S.G.S. and/or <br />U.S.F.S. mapping is ~s follows: upstream <br />terminus in the SE/4 SW/4, Sec.17, T41N, R3W, <br />N . M. P. M. ; downstream terminus in the NE/4 <br />NW/4, Sec, 16, T41N, R3W, N.M.P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />March 9, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on March 9, 1994, by action of the Colorado Water Conservation <br />Board under the provisions of C.R,S. (1990) ~~ 37-92-102(3), <br />37-92 -103 (3), (4), and (10), <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of <br />1.5 c.f.s. (May 1 - August 31); 0.7 c.f.s.
