<br />amounts required under the Englewood-USFS Stipulation. <br /> <br />g. The Denver Water Board holds water rights and owns and maintains <br />diversion structures within the instream flow segment that is the subject of <br />this application, Denver's water rights are decreed in Civil Action Nos. 657 <br />and 1430. The CWCB hereby recognizes that these water rights are senioT <br />to the instream flow appropriation, In addition, the CWCB agrees that it <br />will not prevent Denver from repairing, replacing, or maintaining the <br />diversion structures that are located on this segment of the creek for <br />diverting water held under Civil Action Nos, 657 and 1430, as per S 37-86- <br />111,15 eR.S, (1990). <br /> <br />h, The CWCB recognizes that water stored in upstream reservoirs may <br />be released or delivered into Meadow Creek to be diverted at downstream <br />points, The CWCB shall not prevent or otherwise limit Denver from being <br />able to release or deliver water diverted or stored under Civil Action 657 OT <br />Civil Action 1430 into this segment or assert injury to its appropriation due <br />to such releases or deliveries. The CWCB shall not claim such releases or <br />deliveries as a source of supply for these instream flow water rights, <br /> <br />CONCLUSIONS OF LAW <br /> <br />5, Jurisdiction: The CWCB has complied with the required statutory <br />requirements, full and adequate notice of the CWCB's claims have been given in the <br />manner required by law and no additional notice' needs to be given, The Court has <br />jurisdiction over the subject matter and over all persons with standing to become parties in <br />this case, whether they have appeared or not <br /> <br />6, Incorporation of Findings of Fact: The foregoing findings of fact are <br />incorporated herein to the extent that they constitute conclusions of law, <br /> <br />7, Standards and Burdens of Proof: The CWCB has complied with all <br />requirements, has met all standards and burdens of pToof regarding the Board's <br />appropriation of the Instream Flow water rights requested iri the Application filed in this <br />case, and is therefore entitled to a decree confirming and approving its Instream Flow water <br />rights as more fully described in paragraph 3 above, <br /> <br />JUDGMENT AND DECREE <br /> <br />8. Incorporation of Findings of Fact and CElnclusion of Law: The foregoing <br />Findings of Fact and Conclusions of Law are approved and incorporated herein by <br />reference, <br /> <br />4 <br />
