<br />3. The source of the water is: Possum Creek <br /> <br />4. Legal description of the stream segment through which an instream flow is <br />claimed: <br /> <br />The natural stream channel at the headwaters at latitude 390 38' 42"N and <br />longitude 1070 22' 16"W as the upstream terminus and extending to the <br />confluence of East Canyon Creek at latitude 390 36' 04''N and longitude <br />1070 26' 24"W as the downstream terminus, being a distance of <br />approximately 5.8 miles, This segment can be located on the Adams Lake, <br />Carbonate and Storm King Mountain US.G.S. quadrangles. <br /> <br />For administrative purposes only: <br />Upper Terminus = SW NW SEC 3 TWN 5S RNG 89W 6PM <br />440' East of West Section Line & 2415' South of North Section Line <br />UTM 43 90 834N 13 2 96 542E <br />Lower Terminus = SW NE SEC 24 TWN 5S RNG 90W 6PM <br />1785' West of East Section Line & 2455' South of North Section Line <br />UTM 4686 139N 13 290 S08E. <br /> <br />5, Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6, Date of initiation of appropriation: <br />January 22,2003 <br /> <br />7. The water was first applied to the above beneficial use on January 22, 2003, by <br />the action of the Colorado Water Conservation Board under the provisions of C.R.S. ~ S 37- <br />92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 2.4 cfs (May 1 - <br />August 14) and 1.6 cfs (August 15 - April 30). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 2.4 cfs <br />(May 1 - August ]4) and 1.6 cfs (August 15 - April 30) is hereby entered to preserve the <br />natural environment to a reasonable degree through the stream segment described in <br />paragraph 4 above. The appropriation date for this water right is January 22,2003. <br /> <br />The priority herein awarded was filed in the water court in the year of 2003 and <br />shall be junior to all priorities filed in previous years. As between all rights filed in the <br />same calendar year, priorities shall be determined by historical date of appropriation and <br />not affected by the date of entry of ruling, The Applicant shall install and maintain such <br /> <br />2 <br />
