Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />.The natural stream channel from the headwaters <br />in the vicinity of latitude 39037'55"N and <br />longitude 105035'28"W as the upstream terminus <br />and extending to the confluence of Corral Creek at <br />latitude 39037'56"N and longitude 105027'16"W as the <br />downstream terminus, being a distance of approximately <br />8.7 miles. This segment can be located on the Idaho <br />Springs and Squaw Pass U.S.G.S. quadrangles. <br /> <br />For the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative <br />purposes that the approximate legal description of the <br />instream flow termini as protracted from U.S.G.S. <br />and/or U.S.F.S mapping is as follows: upstream termi- <br />nus in the SW/4 NW/4, Sec. 8, T5S, R73W, 6th P.M., <br />2,300 feet from the North line and 950 feet from the <br />West line; downstream terminus in the SE/4 NW/4, Sec. <br />9, T5S, R72W, 6th P.M., 2,050 feet from the North line <br />and 2,200 feet from the West line. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />September 13, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on September 13, 1994, by action of the Colorado Water Conserva- <br />tion Board under the provision of C.R.S. (1990) ~~ 37-92-102(3), <br />37-92-103 (3), (4), and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of <br />3.0 c.f.s. (April 1 - July 15); 1.5 c.f.s. (July 16 - March 31). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the <br />amount of 3.0 c.f.s. (April 1 - July 15); 1.5 c.f.s. (July 16 - <br />March 31) is entered to preserve the natural environment to a <br />reasonable degree through the upstream and downstream points as <br />described in paragraph 4 above.
