The minimum stream flow right claimed <br />is in the watershed. of the Rio Grande. from its headwaters <br />in vicinity of lat. 31 deg. 25'29" N. long. 106 de9. 31'21" <br />W as the upstream terminus and confluence South Fork Rio <br />Grande at 31 deg. 35'31" north long 106 deg. 43'39" west <br />as the downstream terminus. being a distance of approximately <br />15.1 miles. This segment can be located on the Summitville. <br />Elwood Pass. Beaver Creek Res. U.S.G.S. quadrangle. <br /> <br />d. There is no means of diversion. the claim <br />being to a minimum stream flow of (S-May 1 thru Sept. 30; <br />W-Oct. 1 thru April 30) 58. W6 cubic feet/second of water <br />per second of time. in place in the stream bed. <br /> <br />e. The date of initiation of SUCh appropria- <br />tion pursuant to the action of applicant under the provision <br />of C.R.S. 1913. 31-92-102(3). and 31-92-103(3). (4) and <br />(10) is July 8. 1980. on which date the water of said stream <br />was first applied to beneficial use to maintain the minimum <br />stream flow required to preserve the natural environment to <br />a reasonable aegree. <br /> <br />f. That applicant is entitled to an absolute <br />in place minimum stream flow water right for such beneficial <br />use with a priority date of July 8. 1980. <br /> <br />THEREFORE. IT IS RULED AND ORDERED that the application <br />herein be and it is hereby granted. and that applicant is <br />awarded an absolute in place minimum stream flow water right <br />for S8.W6 cubic feet/foot of water per second of time in <br />Park Creek. with a priority date of July 8, 1980 for the pur- <br />pose of maintaining the minimum stream flow as required to <br />preserve the natural environment to a reasonable degree. <br />unconditionally, SUbject, however, to all priority rights <br />of senior appro~riators of water in the affected watershed. <br /> <br />-2- <br /> <br />,(.~ <br />
