<br />The applicant, Colorado Water Conservation Board, by David
<br />w. Robbins, First Assistant Attorney General, Natural Resources
<br />Section,1525 Sherman Street, Third Floor, Denver, Colorado 80203,
<br />requests the right to use surface waters under the provisions of
<br />C.R.S. 1973, 37-92-102(3) and 37-92-103(3), (4) and (10). Date of
<br />filing: November 16, 1976.

<br />No opposition has been filed.

<br />FINDING OF FACT
<br />
<br />'which
<br />in old

<br />VAN BOXEL CREEK is a tributary to the Little Cimmarron River,
<br />is a tributary of the Gunnison Riverl in Gunnison County and
<br />Water District No. 62.
<br />
<br />NO diversion is claimed and in-place use is being initiated
<br />in accordance with the action of the Colorado Water Conservation
<br />Board under the provisions of C.R.S. 1973, 37-92-102(3) and
<br />37-92-,103 (3), (4) and (10).
<br />
<br />Said use is described as being located from its headwaters.
<br />in Township 46 North, Range 6 West of the N.M.P.M., to its con-
<br />fluence with the Little Cimmarron Riverl in Section 25, Township 47
<br />North, Range 6 West of the N.H.P.M., a distance of approximately
<br />seven miles; the purpose being to appropriate for and by the State
<br />of Colorado such minimum flows as Qre required to preserve the
<br />natural environment to a reasonable degree.
<br />
<br />2.0 c.f.s. of water is claimed as having been appropriated
<br />and used as of July 30, 1976, by action of the Colorado Water
<br />Conservation Board under the provisions heretofore described.

<br />RULING
<br />
<br />IT IS THE RULING OF THE REFEREE that an appropriation of
<br />water has been made under the provisions of C.R.S. ,1973, 37-92-102(3)
<br />and 37-92-103(3), (4) and (10) ,known as Senate Bill No. 97, signed
<br />into law April 23, 19731 and that VAl-l BOXEL CREEK as herein de-
<br />scribed, is APPROVED AND GmulTED an IN-PLACE ABSOLUTE DECREE not to
<br />exceed 2.0 c.f.s. of water for the preservation of the natural
<br />environment, with an appropriation date of July 301 1976.
<br />
<br />PROVIDED, HOl~VER, that this decree is subject to any and
<br />all rights with prior decrees.
