CWCB agrees that the instream flow right decreed in this case is subject to and shall <br />be administered as junior to the water rights described above in paragraphs 2 and 3. CWCB will not <br />prevent operation of the Objector's senior water rights described above at paragraphs 2 and 3 at the <br />existing points of diversion and place of storage, and will not object to any repairs or improvements <br />that Objector may make to the structures and appurtenances associated with the diversion, storage <br />or use ofthe Objector's said senior water rights. <br /> <br />5. The CWCB agrees that it will operate its water rights within the prior appropriation <br />system, and that the water right decreed in this case and the water right decreed to the CWCB in <br />Case No. 85CW626 (collectively referred to herein as the "CWCB Cattle Creek rights") are not <br />intended by the CWCB to be used directly or indirectly as a basis for the imposition of bypass flows <br />or other regulatory requirements for the purpose of providing flows to Cattle Creek, the Roaring <br />Fork River, or the Colorado River, whether through permit proceedings or other regulatory actions. <br /> <br />6.
