Legal dl:5cription of the stream segment through which an instream flow is claimed: The natural stream channel from the confluence of Coulter Creek in the SW/4 NW/4, Sec. 8, T7S, R87W, 6th PM. as the upstream terminus and extending to the Park Ditch in the SW/4 NW/4, Sec. 7, 17S, R87W, 6th P.M. as the downstream terminus, being a distance of approximately 3.5 miles. This segment can be located on the Carbondale V.S.G.S. quadrangle and is depicted on Exhibit A. 5. Vse of the water: Instream flow to preserve the natural environment to a reasonable degree. 6. Date of initiation of appropriation: September22,1997, 7. Water was first applied to benefiL-ial use on September 22, 1997 by action of the Colorado Water Conservation Board pursuant to ~ 37-92-103(4), CRS. (1997). 8. Amount of water claimed (ABSOLUTE): Instream flow of 2.00 c.f.s. (May 1 - October 31). THE WATER REFEREE RULES: The application is granted and a decree (ABSOLUTE) in the amount of 2,00 c.f.s. (May 1 - October 31) is hereby entered to preserve the natur.u environml:Ilt to a reasonable degree through the upstream and downstream points as described in paragraph 4 above. The appropriation date for this water right is September 22, 1997. The priority herein awarded was filed in the water court in the year of 1997 and shall be jWlior to all priorities filed in previous years. As between all rights filed in the same calendar year, priorities shall be determined by historical date of appropriation and not affected by the date of entry of ruling.
