The natural stream channel from the headwaters of Middle Fork <br />Escalante Creek at latitude 380 30' 12" N and longitude \080 34' 04" <br />W as the upstream terminus and extending to the confluence of East <br />Fork Escalante Creek at latitude 380 34' 55" N and longitude \080 24' <br />21" W as the downstream terminus, being a distance of approximately <br />11.4 miles. This segment can be located on the Kelso Point and Snipe <br />Mountain U.S.O.s. quadrangles. <br />b. The water was first applied to the above beneficial use on January 25, 2005, <br />by the action of the Colorado Water Conservation Board under the provisions of CR.S. <br />9937-92-\02(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 1.25 efs (Nov. ] <br />- Mar. 31), 3.1 efs (Apr. 1 - June 14), and 1.6 cfs (Jun. 15 - Oct. 31). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 1.25 cfs <br />(Nov. 1 - Mar. 31), 3.1 cfs (Apr. I - June 14), and 1.6 cfs (Jun. 15 - Oct. 31) is hereby <br />entered to preserve the natural environment to a reasonable degree through the stream <br />segment described in paragraph 4 above. The appropriation date for this water right is <br />January 25, 2005. <br /> <br />The priority herein awarded was filed in the water court in the year of 2005 and <br />shall be junior to all priorities filed in previous years. As between all rights filed in the <br />same calendar year, priorities shall be determined by historical date of appropriation and <br />
