The Board and Idaho Springs acknowledge that Idaho Springs'
acceptance of this proration of stream flow in no way
constitutes an intent to abandon or otherwise relinquish the
use of or any of the Idaho Springs Water Rights.

9. The Instream Flow Rights are and shall be
administered as junior to diversions under the First
Enlargement Right or the Idaho Springs-Coors Exchange Rights
if those rights are confirmed and decreed in Case Nos. 84CW508
and 84CW671. Further, the Board recognizes that beneficial
use of the First Enlargement Right and/or the Idaho Springs-
Coors Exchange Rights may cause inundation of some portion of
the stream segment covered by the Board's application in Case
No. 86CW181. Notwithstanding, the Board agrees that it will
not oppose or protest the water rights applications or rulings
and decrees of Idaho Springs in Case Nos. 84CW508 and 84CW671,
on this or any other basis, and that it will not seek to use
any instream flow water right decreed to it in Case
No. 86CW181 to prevent or prohibit Idaho Springs from storing
water pursuant to decrees awarded in said cases.

10. The Board shall install and maintain such
measuring devices as the Division Engineer may require for the
administration of the Instream Flow Rights.

11. The statements of opposition filed by Idaho
Springs in each of the above-captioned cases shall be
withdrawn, effective upon inclusion of the terms hereof in the
decrees issued in these cases.
