Colorado 80203 <br /> <br />Re: Proposed Reservoir Operation Plan for Black Lake Enlargement <br /> <br />Dear Bill: <br /> <br />On January 30, 1986, the Colorado Department of Natural Resources, <br />through the Colorado Water Conservation Board (CWCB) and the Colorado <br />Division of Wildlife, entered into an agreement with the Vail Valley <br />Consolidated Water District (the District), in settlement of CWCB <br />instream flow claims, the District's augmentation plan, and all issues <br />related to the District's purchase of water from Green Mountain <br />Reservoir. This letter is to provide you and your board, on behalf of <br />the District, with an update on activities of the District pursuant to <br />this agreement and to request your consideration of a proposal for <br />modification and refinement of the rules for operation of reservoir <br />storage at Black Lakes, <br /> <br />Background and Current Status <br /> <br />The key provision of the agreement between the Department of Natural <br />Resources and the District is the District's obligation to provide 300 <br />acre feet of augmentation water to Gore Creek to sustain the natural <br />environment during critical low flow periods. This augmentation water is <br />to be provided through the enlargement of Black Lake No. 1 by 227 acre <br />feet and by use of 73 acre feet of storage in Black Lake No.2. <br /> <br />Since January of 1986, the District has made the repairs and <br />modifications to the spillway and outlet works for Black Lake No, 2 as <br />necessary for making available the 73 acre feet of augmentation water, <br />This work was accomplished during the summer of 1988, Pursuant to the <br />enlargement of Black Lake No.1, the District has obtained approval for <br />issuance of a Special Use Permit from the U,S, Forest Service, a Section <br />401 Certification from the Colorado Water Quality Control Division, and a <br />Section 404 Permit from the U,S, Army Corps of Engineers, The only <br />remaining permit required as a prerequisite to construction is an Eagle <br />County 1041 Land Use Permit, An application for this permit is now <br />pending before the Eagle County Commissioners, The District has also <br />installed a U.S,G.S, gaging station at the Forest Road bridge to monitor <br />streamflows in Gore Creek. <br /> <br />Natural Resource Consultants <br />
