The source of the water is: <br /> <br />Big Spring Creek, tributary to the Closed Basin. <br /> <br />4. Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from the outlet of <br />Indian Spring in the vicinity of latitude <br />3704S'S9"N and longitude 10S037'31"W as the <br />upstream terminus and extending one and four <br />tenths (1.4) miles down stream from Indian <br />Spring to a point located at latitude 3704S'- <br />14"N and longitude 10S038'27"W said point <br />being the downstream terminis. This segment <br />can be located on the Sand Camp U.S.G.S. <br />quadrangle. <br /> <br />For the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative <br />purposes that the approximate legal description of the <br />instream flow termini as protracted from U.S.G.S. <br />and/or U.S.F.S mapping is as follows: upstream termi- <br />nus in the NW/4 NE/4, Sec. 3S, T41N, R12E, N.M.P.M.; <br />downstream terminus in the SW/4 SE/4, Sec. 34, T41N, <br />Rl:2E, N.M.P.M. <br /> <br />S. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />November 3, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on November 3, 1994, by action of the Colorado Water Conservation <br />Board under the provisions of c. R. S. (1990) 1l!; 37 - 92-102 (3) , <br />37- 92-103 (3), (4), and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of <br />4.0 c.Ls. <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the <br />amount of 4.0 c.f.s. is entered to preserve the natural environ- <br />ment to a reasonable degree through the upstream and downstream <br /> <br />2 <br />
