3. The source of the water is:

San Francisco Creek, tributary to the Rio Grande.

4. Legal description of the stream segment through which
,an instream flow is claimed.

The natural stream channel from the conflu-
ence of the West Fork San Francisco Creek and
the Middle Fork San Francisco Creek at lati-
tude 37033'21"N and longitude 106023'38"W as
the upstream terminus and extending to the
U.S,G.S. Gage in the NE/4 SE/4, Sec. 36,
T39N, R5E, N.M.P.M., as the downstream termi-
nus, being a distance of approximately 2.3
miles, This segment can be located on the
Horseshoe Mountain and Dog Mountain U.S.G.S.
quadrangles.

For the stream segments in an unsurveyed area, the
Division Engineer has determined for administrative
purposes that the approximate legal description of the
instream flow termini as protracted from U.S,G.S.
and/or U.S.F,S mapping is as follows: upstream termi-
nus in the SE/4 NW/4, Sec. 11, T38N, R5E, N.M.P.M.

5. Use of the water:

Instream flow to preserve the natural environment to a
reasonable degree.

6. Date of initiation of appropriation:

March 9, 1994.

7. The water was first applied to the above beneficial use
on March 9, 1994, by action of the Colorado Water Conservation
Board under the provisions of C.R.S. (1990) ~~ 37-92-102(3),
37-92-103 (3), (4), (10).
