b. Location:

Legal description of the stream segment through which an
instream flow is claimed: The natural stream channel from
headwaters in the vicinity of lat. 39 deg. 33'00"N, long.
105 deg. 53'32"W as the upstream terminus and extending to
the confluence with Middle Fork Swan River at lat. 39 deg.
30'46"N, long. 105 deg. 56'48"W as the downstream terminus,
being a distance of approximately 4.5 miles. This segment
can be located on the Keystone United States Geological
Survey (U.S.G.S.) quadrangle map(s).

For administrative purposes only, the Division Engineer for
Water Division 5 has translated the segment thus described
into approximate protracted section, township, and range
locations from U.S.G.S. mapping as follows: Upstream
terminus in the NE/4 SW/4 S4 T6S R76W 6th P.M., more SDe-
cifically at a point whence the SW corner of S18 T6S R76W
bears N50 30E a distance of 16,500 ft.; downstream terminus
in the NE/4 SW/4 S24 T6S R77W 6th P.M., more specifically
at a point whence the NE corner of S24 bears S43 OOW a dis-
tance of 4,025 ft.

c. (1) Date of initiation of appropriation: November 8,
1985.

(2) Date water applied to beneficial use: Water was first
applied to beneficial use on November 8, 1985, pursuant to
S 37-92-103(4), C.R.S. (1973).

(3) How appropriation was initiated: By applicant's
approval of its staff's final recommendations at a regu-
larly scheduled meeting, subsequent to having requested and
considered recommendations from the Division of Wildlife,
and the Division of Parks and Outdoor Recreation.

d. Amount of water claimed:

Instream flow of 2.0 c.f.s. absolute.
