<br />FINDINGS OF FACT ..'
<br />
<br />1. An Application for Water Rights to Protect the Natural Environment to a Reasonable
<br />Degree was filed on December 31, 1998. '
<br />
<br />2. The Water Clerk caused publication of such filing as provided by statute; that the
<br />time for filing Statements of Opposition expired on the last day of February 1999, and
<br />that none has been filed.
<br />
<br />3. The Application concerns a claim for an instream flow in Hunkydory Creek located
<br />in Chaffee County, Colorado, to protect the natural environment to a reasonable
<br />degree. '
<br />
<br />4. The Division Engineer has filed his Consultation Report dated May 13, 1999,
<br />pursuant to C.R.S. 37-92-302(4), and the Referee has given it due consideration.
<br />
<br />5. The Applicant has furnished acceptable proof as to claims made.
<br />
<br />IT IS, THEREFORE, ORDERED AS FOLLOWS: The Applicant be, and is
<br />hereby, awarded an instream flow water right, to-wit:
