Case No. 92CW081 flLtO STATE ~~AII:'It U'V. b COLORADO AUG 72 1994 DISTRICT COURT, WATER DIVISION 6, COLORADO ------------------------------~---------------------------------- RULING OF REFEREE AND DECREE OF THE WATER COURT ----------------------------------------------------------------- IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF THE COLORADO WATER CONSERVATION BOARD ON BEHALF OF THE PEOPLE OF THE STATE OF COLORADO IN INDIAN RUN CREEK, A NATURAL STREAM IN THE WATERSHED OF THE YAMPA ~IVER IN RIO BLANCO AND ROUTT COUNTIES, COLORADO. ----------------------------------------------------------------- The above captioned Application was filed on December 11, 1992, and was referred to the Water Referee for Water Division No.6, in accordance with C.R.S. 37-92~101, et seq. (1990 Repl. Vol. 15). All notices of the filing of this Application which are required by law have been fulfilled and the Referee has jurisdiction of this Application. On March 5, 1993, the Division Engineer submitted a Sum- mary of Consultation recommending approval of the Application. A Statement of Opposition was filed by sixteen (16) indi- viduals. Fifteen of the sixteen individual Objectors have en- tered into a stipulation with the Applicant which was approved by the Referee on May 20, 1994. To resolve the objectors' concerns with the Application filed in this case, the CWCB has agreed that: a. it will not oppose, object to or protest an applica- tion filed by any of the Objectors in this case who wish to change any current point of diversion, located within the minimum stream flow reach applied for in this case, to a new point of diversion So long as the Objector is entitled to extend the head of such ditch pursuant to the provisions of C.R.S. 37-86-111. b. The current statutory provisions permitting the fil-
