Legal description of the stream segment through which an
instream flow is claimed: The natural stream channel from
headwaters in the vicinity of lat, 39 deg, 3l'2l"N, long,
105 deg, 52'16"W as the upstream terminus and extending to
the confluence with Snake River at lat, 39 deg, 33'49"N,
long. 105 deg. 5l'37"W as the downstream terminus, being a
distance of approximately 3.3 miles. This segment can be
located on the Montezuma U.S.G.S, quadrangle(s),

For administrative purposes only, the Division Engineer for
Water Division 5 has translated the segment thus described
into approximate protracted section, township, and range
locations from U,S.G.S. mapping as follows: Upstream
terminus in the SE/4 NE/4 S15 T6S R76W 6th P,M" more spe-
cifically at a point whence the SE corner of said section
bears N23 30W a distance of 3,000 ft., downstream terminus
in the NE/4 NW/4 S2 T6S R76W 6th P,M" more specifically at
a point whence the SW corner of said section bears N15 OOE
a distance of 6,850 ft.

(2) Date water applied to beneficial use: Water was first
applied to beneficial use on November 8, 1985, pursuant to
S 37-92-103(4), C,R,S, (1973),
