3. The source of the water is:

West Fork San Francisco Creek, tributary to San Fran-
cisco Creek, a tributary to the Rio Grande.

4. Legal description of the stream segment through which
an instream flow is claimed.

The natural stream channel from the headwaters
in the vicinity of latitude 37030'10"N and
longitude 106025'45"W as the upstream terminus
and extending to the confluence of Middle Fork San
Francisco Creek at latitude 37033'21"N and longitude
106023'38"W as the downstream terminus, being a
distance of approximately 4.5 miles. This segment
can be located on the Horseshoe Mountain U.S.G.S.
quadrangle.

For the stream segments in an unsurveyed area, the
Division Engineer has determined for administrative
purposes that the approximate legal description of the
instream flow termini as protracted from U.S.G.S.
and/or U.S.F.S mapping is as follows: upstream termi-
nus in the NE/4 NW/4, Sec. 33, T38N, R5E, N.M.P.M.;
downstream terminus in the SE/4 NW/4, Sec. 11, T38N,
R5E, N.M.P.M.

5. Use of the water:

Instream flow to preserve the natural environment to a
reasonable degree.

6. Date of initiation of appropriation:

March 9, 1994.

7. The water was first applied to the above beneficial use
on March 9, 1994, by action of the Colorado Water Conservation
Board under the provisions of C.R.S. (1990) ~~ 37-92-102(3),
37-92-103 (3), (4), and (10).

8. Amount of water claimed (ABSOLUTE): Instream flow of
4.0 c.f.s. (April 15 - July 31); 1.25 c.f.s. (August 1 - April
14) .
