does hereby make the following determination and ,:"uling as
the referee in this matter, to wit:

5_ Description of beginning and end points of mini-
mum stream flow claimed: the natural stream channel from
headwate(S in vicinity of lat 40 deg 06-43" N, long 106 deg
43'07" w as the upstream terminus and confluence Toponas
Creek, lat 40 deg 05-05" N, long 106 deg 42-04" W as the
downstream terminus.

6. The use of the water is to appropriate such mini-
mum' stream flows as are required to preserve the natural
environment to a reasonable degree.
