STIPULATION

COME NOW the United States of America, by its attOlneys,

and the Applicant, Colorado W~ter Conservation Board, by and

through its attorneys, and hereby stipulate and agree as follows:

1. The inc1u~ion of the following provisions in the

Referee's ruling and decree of Co~r~ entered thereon will 'protect

the interests of the United States of America:

a. Applicant's rights are subject to all senior

,.~ights of the United States of America in the
~ubject source, including properly decreed
reserved rights, as are now OT will hereafter

be determined by law.

b. Applicant shall apply for any special use permits.

this matter by the Referee pursuant to applicable statutes,
