The source of the water is: <br />South Fork Mesa Creek, tributary to the Dolores River. <br /> <br />4. Legal description of the stream segment through which an instream <br />flow is claimed: <br /> <br />The confluence of an wmamed tributary at latitude 380 31' 08"N and <br />longitude 1080 38' 49"W as the upstream terminus and extending to the <br />confluence of East Mesa Creek at latitude 380 36' 55"N and longitude 1 080 <br />47' 27"W as the downstream terminus, being a distance of approximately <br />10,4 miles. This segment can be located on the Uncompahgre Butte, Red <br />Canyon and Atkinson Creek U.S,G,S, quadrangles. <br /> <br />5. Use of water: <br /> <br />Instream flow to preserve the natural environment to a reasonable <br />degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />January 23, 2002. <br /> <br />7. The water was ftrst applied to the above beneficial use on January 23, <br />2002, by action of the Colorado Water Conservation Board under the <br />provision ofC.R.s. ~ ~ 37-92-102(3),37-92-103(3), (4), (10). <br /> <br />8, Amount of water claimed (ABSOLUTE): Instream flow of 1.25 cfs <br />(March 1 - March 3!); 2.0 cfs (April 1 - May 31); 0,3 cfs (June I - <br />February 29). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The Application is granted and a decree in the amount of (ABSOLUTE) <br />Instream flow of 1.25 cfs (March I ~ March 31); 2,0 cfs (April! - May 3!); 0,3 cfs (June <br />1 - February 29) is hereby entered to preserve the natural environment to a reasonable <br />degree through the upstream and downstream points as described in paragraph 4 <br />above, The appropriation date for this water right is January 23,2002. <br />
