The name and address of the claimant is: <br /> <br />The Colorado Water Conservation Board <br />1313 Sherman St.. 8th Floor <br />Denver. CO 80203 <br /> <br />c. There is no point of diversion as such. <br />and none is claimed. The minimum stream flow right claimed <br />is in the watershed of the Rio Grande, from its headwaters <br />in NW/4 SE/4 sec. 7. T38N. R4E. N.M.P.M. as the upstream <br />terminus and confluence Beaver Creek in SE/4 SW/4 sec. 34. <br />T39N. R3E. N.M.P.M. as the downstream terminus. being a dis- <br />tance of approximately 4.7 miles. This segment can be locat- <br />ed on the Del Norte Peak, Beaver Creek, Res. U.S.G.S. quadrangle. <br /> <br />d. There is no means of diversion. the claim <br />being to a minimum stream flow of 4 cubic feet/second of <br />water per second of time. in place in the stream bed. <br /> <br />e. The date of initiation of suCh appropria- <br />tion pursuant to the action of applicant under the provision <br />of C.R.S. 197J. 37-92-102(3). and 37-92-103(3). (4) and <br />(10) is July 8. 1980. on which date the water of said stream <br />was first applied to beneficial use to maintain the minimum <br />stream flow required to preserve the natural environment to <br />a reasonable degree. <br /> <br />f. That applicant is entitled to an absolute <br />in place minImum stream flow water right for such beneficial <br />use with a ~riorjty date of July 8. 1980. <br /> <br />THEREFORE. IT IS RULED AND ORDERED that the application <br />herein be and it is hereby granted. and that applicant is <br />awarded an absolute in place minimum stream flow water right <br />for 4 cubic feet/foot of water per second of time in Cross <br />Creek. with a priority date of July 8. 1980 for the purpose <br />of maintaining the minimum stream flow as required to pre- <br />serve ,the natural environment to a reasonable degree. uncon- <br />ditionally. subject. however. to all priority rights of . <br />senior appropriators of water in the affected watershed. <br /> <br />-2- <br /> <br />~.~. <br />
