Applicant shall not oppose, object to, or protest a change in <br />point of diversion of an absolute water right upstream from its <br />decreed point of diversion to a new point of diversion within the <br />reach of the minimum stream flow decree applied for, when the owner <br />of such water right (a) is entitled to extend the head of such <br />ditch upstream pursuant to the provisions of C.R.S. 37-86-111, or <br />(b) seeks to improve the grade and location of all or part of the <br />ditch as necessary to receive and deliver for beneficial use the <br />proper inflow of water to which it may be entitled from such <br />stream. <br /> <br />11.
