Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />'The natural stream channel from the confluence of <br />Truesdell Creek at latitude 39036'36"N and <br />longitude 105032'07"W as the upstream terminus <br />and extending to the inlet of Evergreen Lake at lati- <br />tude 39037'57"N and longitude 105019'55"W as the down- <br />stream terminus, being a distance of approximately 13.5 <br />miles. This segment can be located on the Harris Park, <br />Meridian Hill, Squaw Pass and Evergreen U.S.G.S. quad- <br />rangles. <br /> <br />FOr the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative <br />purposes that the approximate legal description of the <br />instream flow termini as protracted from U.B.G.S. <br />and/or U.S.F.S mapping is as follows: upstream termi- <br />nus in the SW/4 SW/4, Sec. 14, T5S, R73W, 6th P.M., 50 <br />feet from the South line and 800 feet from the West <br />line; downstream terminus in the SW/4 NW/4, Sec. 10, <br />T5S, R71W, 6th P.M., 1,900 feet from the North line and <br />1 foot from the West line. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />September 13, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on September 13, 1994, by action of the Colorado Water Conserva- <br />tion Board under the provision o( C.R.S. (1990) ~s 37-92-102(3), <br />37-92-103 (3), (4), and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of <br />10.0 c.Ls. (April 15 - October 15); 5.0 c.Ls. (October 16 - <br />April 19). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the <br />amount of 10.0 c.Ls. (April 15 - October 15); 5.0 c.f.s. (Octo- <br />ber 16 - April 16) is entered to preserve the natural environment <br />to a reasonable degree through the upstream and downstream points <br /> <br />2 <br />
