RULING OF REFEREE

Pursuant to Order of Referral filed and entered in

the. above case on December 29, 1977, the undersigned Water

R~feree, having investigated the matter of the Application

on file herein, hereby makes the following findings and rul-
ing thereon:

FINDINGS OF FACT

1. That the said Application was filed on December 29,

1977.

2. That the lqater Clerk caused publication of such filing
as provided by statute; that the time for filing Statements of
Opposition expired on the last day of February, 1978, and that
,such a statement was filed on February 27, 1978, by HO\<ard
HOlme, Attorney at Law, on behalf of the Southeastern Colorado

Water Conservancy District, and such a statement was filed on

~Iareh 24, 1978, by William V. Crossman, Attorney at Law, on
behalf of Hark J. DeAngelo and Beverly P. DeAngelo.
3. That on Hareh 16, '1978, the undersigned Water Referee
re-referred the case to the Water Judge pursuant to the authority

granted the said Referee in C.R.S. 1973, 37-92-303(2J.
