Applicant seeks the right to maintain certain

minimum flows of water on said stream.

3. Facts why application for water rights should

not be granted or should be granted in part or on certain
conditions:

a. Applicant claims the right to use water

to maintain certain levels of minimum water flow on

the North Fork of Middle Boulder Creek within Boulder

County, Colorado, in order to protect the natural

environment. The applicant cites S 37-92-102(3) and S
37-92-103(3), (4), and (10) as authority for such claim
of water right. Said statutory authority is in violation
of art. XVI, S 5 and art. XVI, S 6 of the Colorado
Constitution. The cited sections of the Constitution

do not permit the appropriation of water solely for

the maintenance of minimum levels of stream flow.
