The above entitled application was filed on August 19, 1980,

and was referre(! to tlle undersigned as Water Referee for Water

Division No.5, State of COlorndo, iJY tlle Water Judge of said Court
011 tIle 15tl1 day of September, 1980, and again, after' withdrawal of
opposition, on August 7, 1981, in accoruance \dth Article 92 of
Chapter 37, Colorado Revised Statutes 1973, known as The Water
Right Determination and Administration Act of 1969.

to Rifle Creek, tributary to the Colorado River.

S. Description of beginning and end points of minimum stream
fl.ow claimed: the natural stream channel from its headwaters in
the NIi-l/4- NE-I/4 of Section I, 1',45.. R.94N, of the 6th P,fl. as
the upstream terminus, and Rifle Gap Reservoir at Lat. 39038/161! N.;
Long. 107046124'1 iV. as the dmmstrearn terminus.

6. The use of the water is to appropriate such minimum stream
flows as are required to preserve the natural environment to a
reasonable degree.

7. The date of initiation of appropriation is May 7, 1980.
