Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />,The natural stream channel from the confluence of <br />Beartrack Creek at latitude 39035'56"N and <br />longitude 105034'25"W as the upstream terminus <br />and extending to the confluence of Truesdell Creek at <br />latitude 39036'36"N and longitude 105032'07"W as the <br />downstream terminus, being a distance of approximately <br />2.5 miles. This segment can be located on the Harris <br />Park U.S.G.S. quadrangle. <br /> <br />For the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative <br />purposes that the approximate legal description of the <br />instream flow termini as protracted from U.S.G.S. <br />and/or U.S.F.S mapping is as follows: upstream termi- <br />nus in the SW/4 SW/4, Sec. 21, T5S, R73W, 6th P.M., <br />1,000 feet from the South line and 500 feet from the <br />West line; downstream terminus in the SW/4 SW/4, Sec. <br />14, T5S, R73W, 6th P.M., 50 feet from the South line <br />and 800 feet from the West line. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />September 13, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on September 13, 1994, by action of the Colorado Water Conserva- <br />tion Board under the provision of C.R.S. (1990) ~~ 37-92-102(3), <br />37-92-103 (3), (4), and (10). <br /> <br />8 . <br />7.5 c.f.s. <br />April 14). <br /> <br />THE WATER REFEREE RULES: <br /> <br />Amount of water claimed (ABSOLUTE): <br />(April 15 - October 15); 3.0 c.f.s. <br /> <br />Instream flow of <br />(October 16 - <br /> <br />The application is granted and a decree (ABSOLUTE) in the <br />amount of 7.5 c.f.s. (April 15 - October 15); 3.0 c.f.s. (October <br />16 - April 14) is entered to preserve the natural environment to <br />a reasonable degree through the upstream and downstream points as <br />described in paragraph 4 above.
