Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream cnannel from the head- <br />waters in the vicinity of latitude 37042'16"N and <br />longitude 106046'51"Vl as the upstream terminus and <br />extending to the contluence of Goose Creek in the SW/4 <br />NE/4, Sec. 2, T40N, RIE, N.M.P.M. as the downstream <br />terminus, being a di~tance of approximately 4.5 miles. <br />This segment can be located on the Lake Humphreys <br />U.S.G.S. quadrangle. <br /> <br />For the stream segme~ts in an unsurveyed area, the <br />Division Engineer ha~ determined for administrative <br />purposes that the approximate legal descr~ption of the <br />instream flow termini as protracted from V.S.G.S. <br />and/or U.S.F.S mappiDg is as follows: up~tream termi- <br />nus in the SE/4 NW/4, Sec. 20, T40N, R2E, N.M.P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />March 9, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on March 9, 1994, by action of the Colorado Water Conservation <br />Board under the provisions of c.R.S. (1990) ~~ 37-92-102(3), <br />37-92-103 (3), (4), and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of <br />0.75 c.f.s (April 1 - October 15); 0.25 c.f.s (October 16 - March <br />31) . <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the <br />amount of 0.75 c.f.s. (April 1 - October 15); 0.25 c.f.s (October <br />16 - March 31) is entered to preserve the natural environment to <br />a reasonable degree through the upstream and downstream points as <br /> <br />2 <br />
