The purpose of <br />this appropriation by the state of Colorado is to insure <br />the preservation of a minimum stream level to protect <br />the~natural environment to a reasonable degree. <br /> <br />8. The Applicant, by Stipulation, doe~ not acknowledge at this <br />time any rights to water by the United States of America, <br />but in the future if the United States of America shall seek <br />appropriate judicial determination of any claimed water <br />rights in the watershed involved herein,-the Applicant <br />stipulates and agrees that its rigUt shall be subject to any <br />adjudicated senior right of the United States of America. <br /> <br />9. The priority herein awarded said J~mes Creek was filed in <br />the Water Court in the year of 1978 and shall be administered <br />as having been filed in that year; and shall be junior to <br />all priorities filed in previous ysars.
