THIS CLAIM, having been filed with the Water Clerk, Water Division

No.1, on September 29, 1978 and the Referee being fully advised in the

premises, does hereby find:

All notices required by law of the filing of this application

have been fulfilled, and the Referee has jurisdiction of this application.

Statements of Opposition were filed ~y the U.S.A. and Bluepond

Associates and the time for filing additional statements has expired.

Subsequently the Statement of Opposition of Bluepond Associates was

withdrawn.

All matters contained in the application having been reviewed,

and testimony having been taken where such testimony is necessary, and

such corrections made as are indicated by the evidence presented herein,

The natural stream channel from headwaters in
vicinity of lat 39036'33" North, long 105039'57"
West as the upstream terminus. This is in an
unsurveyed area but appears to be in Section 22,
Township 5 South, Range 74 West of the 6th P.M.,
C1eer Creek County and the confluence of Geneva
Creek at lat 39030'17" North, long 105042'14" West
as the downstream terminus and appears to be in
SE~, Section 19, Township 6 South, Range 74 West
of the 6th P.M., Park County, at a point
approximately 4700 feet South and 600 feet West
of the NE Corner, Section 19, a distance of
approximately 10 mi.1es.
