RULING OF REFEREE

Pursuant to Order of Referral filed and entered in the

above case on May 17, 1976, the undersigned Water Referee,

having investigated the matter of the application on file

herein, hereby makes the following findings and ruling thereon:

FINDINGS OF FACT

l~ That the said application was filed on May 17, 1976.

2. That the Water Clerk caused publication of such filing

as provided by statute; that the time for filing Statements of

Opposition expired on the last day of July, 1976, and that none

has been filed.

3. That the said application concerns a stream located in

Saguache County, Colorado, and used for such ~inimum flows as
are required to preserve the natural ,environment to a" reasonable

degree, and the claim for appropriation is made under the

provisions of CRS 1973, 37-92-102(3), 37-92-103(3), (4) and (10).

4. That Applicant has furnished acceptable proof as to

claims made.

IT IS, THEREFORE, ORDERED AS FOLLOWS: That Applicant be,

and is hereby, awarded an absolute surface water right, to-wit:
