<br />District Court, Div, 5 <br />CWCB; Case No, 97CW272 <br />Ruling <br /> <br />3, The source of the water is: <br /> <br />a. Upper Antones Cabin Creek, tributary to Brush Creek, tributary to the <br />Eagle River; <br /> <br />b, Lower Antones Cabin Creek, tributary to Brush Creek, tributary to the <br />Eagle River; <br /> <br />c. Antones Cabin Creek is shown on the Red Creek and Crooked Creek Pass <br />U.S,G.S. Quadrangle maps as a single continuous stream; however, that <br />does not accurately reflect conditions on the ground. As more completely <br />described in paragraph 9, below, the stream shown as Antones Cabin <br />Creek on the referenced maps actually consists of two distinct stream <br />segments, referred to herein as Upper Antones Cabin Creek and Lower <br />Antones Cabin Creek. At leastUpper Antones Cabin Creek, and perhaps <br />both Upper and Lower Aritones Cabin Creek together, were previously <br />known and identified on maps and in prior court decrees as "Lost Creek." <br />For purposes of this ruling, these two stream segments are identified as <br />"Upper Antones Cabin Creek" and "Lower Antones Cabin Creek." <br /> <br />4. <br />claimed: <br /> <br />The legal descriptions of the stream segments through which instream flows are <br /> <br />a. Upper Antones Cabin Creek Segment:' A segment of the natural stream <br />channel of Upper Antones Cabin Creek from its headwaters in the vicinity of <br />latitude 39025'58" N and longitude 1060 46'47"W as the upstream terminus <br />and extending to the headgate of the L.E.D.E. Ditch, decreed in Civil Action <br />No. 963, District Court in and for Eagle County, as being located on the left <br />bank of Los! Creek (a.k.a. Antone's Cabin Creek) at a point whence the <br />Southeast Corner of Section 2, T7S, R84W, of the 6th P.M. bears North <br />19025'00" West 6, 327 feet. This segment is a length of approximately 1.4 <br />miles; <br /> <br />b, Lower Antones Cabin Creek Segment: A segment of the natural stream <br />channel of Lower Antones Cabin Creek from its confluence with an <br />unnammed tributary at latitude 39027' 10''N and longitude 106045 '27"W as <br />the upstream terminus to the confluence of West Brush Creek at latitude 390 <br />28' 57"N and longitude 1060 44' 31 "Was the downstream terminus.
