Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from the headwaters <br />in the vicinity of latitude 37052'23"N and longitude <br />107004'31"W as the upstream terminus and extending to a <br />point which corresponds with the Bennett Creek intake <br />location for Santa Maria Reservoir Company at latitude <br />37050'12"N and longitude 107007'35"W as the downstream <br />terminus, being a distance of approximately 4.4 miles. <br />This segment can be located on the Bristol Head and <br />Hermit Lakes U.S.G.S. quadrangles. <br /> <br />For the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative <br />purposes that the approximate legal description of the <br />instream flow termini as protracted from U.S.G.S. <br />and/or U.S.F.S mapping is as follows: upstream termi- <br />nus in the SE/4 SW/4, Sec. 22, T42N, R2W, N.M.P.M.; <br />downstream terminus in the SW/4 SE/4, Sec. 6, T41N, <br />R2W, N.M.P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />March 9, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on March 9, 1994, by action of the Colorado Water Conservation <br />Board under the provisions of C.R.S. (1990) ~~ 37-92-102(3), <br />37-92-103 (3), (4), and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of <br />1. 50 c. f. s. (April 1 - October 15); 0.50 c. f. s. (October 16 - <br />March 31). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree in the amount of <br />1.50 c.f.s. (April 1 - October 15); 0.50 c.f.s. (October 16 - <br />March 31) is entered to preserve the natural environment to a <br />reasonable degree through the upstream and downstream points as <br />described in paragraph 4 above. The appropriation date for this <br />water rights is March 9, 1994. <br /> <br />2 <br />
