3. The source of the water is:

Big Spring Creek, tributary to the Closed Basin.

4. Legal description of the stream segment through which
an instream flow is claimed.

The natural stream channel from one and four
tenths (1.4) miles down stream of Indian
Spring in the vicinity of latitude 37045'14"N
and longitude 105038'27"W as the upstream
terminus and extending to the headgate of Los
Ojos Ditch at latitude 37044'07"N and lon-
gitude 105040'04"W being a distance of ap-
proximately 2.35 miles. This segment can be
located on the Sand Camp and Medano Ranch
U.S.G.S. quadrangles.

For the stream segments in an unsurveyed area, the
Division Engineer has determined for administrative
purposes that the approximate legal description of the
instream flow termini as protracted from U.S.G.S.
and/or U..8.F.S mapping is as follows: upstream termi-
nus in the NE/4 SW/4 SE/4, Sec. 34, T41N, R12E,
N.M.P.M.; downstream terminus in the NE/4 NW/4, Sec. 9,
T40N, R12E, N.M.P.M.

5. Use of the water:

Instream flow to preserve the natural environment to a
reasonable degree.

6. Date of initiation of appropriation:

November 3, 1994.

7. The water was first applied to the above beneficial use
on November 3, 1994, by action of the Colorado Water Conservation
Board under the provisions of C.R.S. (1990) ~~ 37-92-102(3),
37-92-103 (3), (4), and (10).

8. Amount of water claimed (ABSOLUTE): Instream flow of
6.0 c.f.s.

THE WATER REFEREE RULES:

The application is granted and a decree (ABSOLUTE) in the
amount of 6.0 c.f.s. is entered to preserve the natural environ-
ment to a reasonable degree through the upstream and downstream
