The source of the water is: <br /> <br />Big Spring Creek, tributary to the Closed Basin. <br /> <br />4. Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from one and four <br />tenths (1.4) miles down stream of Indian <br />Spring in the vicinity of latitude 37045'14"N <br />and longitude 105038'27"W as the upstream <br />terminus and extending to the headgate of Los <br />Ojos Ditch at latitude 37044'07"N and lon- <br />gitude 105040'04"W being a distance of ap- <br />proximately 2.35 miles. This segment can be <br />located on the Sand Camp and Medano Ranch <br />U.S.G.S. quadrangles. <br /> <br />For the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative <br />purposes that the approximate legal description of the <br />instream flow termini as protracted from U.S.G.S. <br />and/or U..8.F.S mapping is as follows: upstream termi- <br />nus in the NE/4 SW/4 SE/4, Sec. 34, T41N, R12E, <br />N.M.P.M.; downstream terminus in the NE/4 NW/4, Sec. 9, <br />T40N, R12E, N.M.P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />November 3, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on November 3, 1994, by action of the Colorado Water Conservation <br />Board under the provisions of C.R.S. (1990) ~~ 37-92-102(3), <br />37-92-103 (3), (4), and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of <br />6.0 c.f.s. <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the <br />amount of 6.0 c.f.s. is entered to preserve the natural environ- <br />ment to a reasonable degree through the upstream and downstream <br /> <br />2 <br />
