THIS MATTER. having come on before the court on the appl i-
catl01 of the Colorado Water Conservation Board and the court
being full y advised as to the matter of the appl ication herein.
hereby makes the following findings:

The ap~lication herein was filed with the water clerk.
Water Division 4 on May 13.1960. All notIces required by law
for the filing of this ap~licatlon have been fulfilled. and the
court has Jurisdiction over the appl ication.

The United States of America timely filed a statemeht of
opPosition. A stipulation was reached between the United States
and the ap~1 icant herein and such stipulation is made part of and
incorporated into this proposed ruling. the terms of which are as
follows:

1. Ap;J1 icant' s rights are subject to all senior rights
of the United States of America In the subject source. Including
properly decreed reserved rights. as are now or wi 11 hereafter oe
determined by law.

2. Appl icant shall apply for any special use permits or
rights-of-way. as the case may be. if the same are required by
law for the use of publiC resources contemplated oy the subject
application and shall abide by the conditions set forth therein.
