7. The use of the water:

This appr.opriation is made pursuant to C.R.S. 1973,
37-92-102(3) and 37-92-103(3) and (4). The purpose
of this appropriation by the State of Colorado is to
insure the preservation of a minimum stream level to
protect the natural environment to a reasonable degree.

8. The Applicant, by Stipulation, does not acknowledge at this
time any rights to water by the United Statee of America, but in the
future if the United States of America shall seek appropriate Judicial
determination of any claimed water rights in the watershed involved
herein, the Applicant stipulates and agrees that its right shall be
subject to any adjudicated senior right of the United States of America.

9. The priority herein awarded said South Fork Cache La Poudre
River (Upper) was filed in the Water Court in the year of 1978 and
shall be administered as having been filed in that year; and shall be
junior to all priorities filed in previous years. As between all
rights, filed in the same calendar year, priorities shall be determined
by historical dates of appropriation and not affected by the date of
entry of ruling.
