The natural stream channel from the confluence of the East and West <br />Forks at latitude 380 26' 13" N and longitude 1080 05' 01" W as the <br />upstream terminus and extending to the Uncompahgre Valley Project <br />Canal and Siphon at latitude 380 32' 48" N and longitude 108002' 59" <br />W as the downstream terminus, being a distance of approximately 10.3 <br />miles. This segment can be located on the Dry Creek Basin and <br />Hoovers Corner U.S.G.S. quadrangles. <br />b. For administrative purposes only: <br />Upper Terminus = NW NE S9 T48N Rl1 W NMPM <br />2170' East of West Section Line 350' South of North Section Line <br />UTM 4258788 N 230861 E Zone 13 <br />Lower Terminus = NW NE S 1 T49N Rll W NMPM <br />2630' West of East Section Line 440' South of North Section Line <br />UTM 4270867 N 234214 E Zone 13 <br /> <br />5. Use ofthe water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 25, 2005. <br /> <br />7. The water was first applied to the above benefIcial use on January 25,2005, <br />by the action of the Colorado Water Conservation Board under the provisions of c.R.S. <br />S S 37-92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of3.0 cfs (Mar. 1 <br />- Mar. 31), 7.3 cfs (Apr. 1 - June 14), 3.0 cfs (June 15 - July 31), and 1.2 cfs (Aug. 1 - <br />Feb. 28). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of3.0 cfs <br />(Mar.l-Mar.31), 7.3 cfs(Apr.I-June 14), 3.0 cfs (June 15 -July31),and 1.2cfs <br />(Aug. 1 - Feb. 28) is hereby entered to preserve the natural environment to a reasonable <br />degree through the stream segment described in paragraph 4 above. The appropriation <br />date for this water right is January 25, 2005. <br /> <br />The priority herein awarded was filed in the water coU/1 in the year of 2005 and <br />shall be junior to all priorities filed in previous years. As between all rights filed in the <br />same calendar year, priorities shall be determined by historical date of appropriation and <br />not affected by the date of entry of ruling.
