Weiss, and <br />Objector Durango Ski Corporation ("Durango"), by and through <br />its attorneys, Calkins, Kramer, Grimshaw & Harring, hereby <br />stipulate as follows: <br /> <br />WHEREAS the Board filed an application for water rights <br />in the East Fork of Hermosa Creek in Case No. 84CW278, Water <br />Division 7, to which Durango filed a timely Statement of <br />Opposition 1 and <br /> <br />WHEREAS the Board filed an application for water rights <br />in Hermosa Creek in Case No. 84CW281, Water Division 7, to <br />which Durango filed a timely Statement of Opposition; <br /> <br />WHEREAS the Board filed an application for water rights <br />in Hermosa Creek in Case No. 87CW46, Water Division 7, to <br />which Durango filed a timely Statement of Opposition, <br /> <br />WHEREAS the Board filed an application for water rights <br />in Hermosa Creek in Case No. 87CW55, Water Division 7, to <br />which Durango filed a timely Statement of Opposition; <br /> <br />WHEREAS Durango has decreed water rights in Case Nos. <br />8lCW144, 8lCW148, W-434, W-435, 84CW123, 84CW124, 84CW125, <br />and 84CW202 which are .senior to all of the Board's filings, <br />and <br /> <br />WHEREAS Durango may desire to change its vested water <br />rights to better accommodate its planned development. <br /> <br />NOW THEREFORE the parties agree as follows: <br /> <br />1. The decree in Case No. 84CW278 will provide for <br />the Board's request of a minimum streamflow of 1. 5 c. f. s. <br />winter and 3.0 c.t.s. summer. <br /> <br />2. Although Durango's water rights are senior to this <br />m~n~um streamflow, Durango agrees to bypass the first .5 <br />c.t.s. of flow on East Fork of Hermosa Creek. <br />
