STIP,ULATION

COME NOW the United States of America, by its attOl"neys,
and the Applicant, Colorado Water Conservation Board, by and .
through its attorneys, and hereby stipulate and agree as follows:

1. The' inclusion of the following provisions in the
Referee's ruling and decree of Court entered thereon will protect

the interests of the United States of America:

a. Applicant's rights are subject to all senior

..rights of the United States of America in the
~ubject source, including properly decreed

reserved rights, as are now or will hereafter

be determined by law.

b. Applicant shall apply for any special use permits

or rights-of-way, as the case may be, if the

same are required by law for the use of public
resources contemplated by the subject application

and shall abide by the conditions set forth

therein.

2, The parties hereto consent to the determination of

this matter by the Referee pursuant to applicable statutes,

a~d consistent with this Stipulation.
