Board <br /> <br />a.The natural stream channel from outlet Pear Lake at latitude 380 54' 39" <br />N and longitude 1060 23' 0 I " W as the upstream terminus and extending to <br />confluence Texas Creek at latitude 380 52' 42"N and longitude 106023' <br />54" W as the downstream terminus, being a distance of approximately 2.8 <br />miles. This segment can be located on the Winfield and Tincup U.S.O.S. <br />quadrangles. See Exhibit A. <br /> <br />b, Administration: For the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative purposes that the <br />approximate legal description of the instream flow termini as protracted <br />from U,S.O,S, and/or U,S,F,S, mapping is as follows: downstream <br />terminus in the SW Y. NW Y. See, 36, TI3S, R8IW, 6th P.M. <br /> <br />5. Use of water: <br /> <br />To preserve the natural environment to a reasonable degree, <br /> <br />6. (October <br />I - December 14); 0.5 c.f,s, (December IS-April 30) <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree in the amount of (ABSOLUTE): <br />Instream flow of2,75 c,f.s. (May I-July 31); 1.5 c.f.s. (August I - September 30); <br />0.75 c.f,s, (October I - December 14); 0,5 c.f.s. (December IS-April 30) is hereby <br />entered to preserve the natural environment to a reasonable degree through the <br />upstream aud downstream points as described in paragraph 4 above, The <br />appropriation date for this water right is May I I, 1998 <br /> <br />The priority herein awarded was filed in the water court in the year of 1998 <br />and shall be junior to all priorities filed in previous years. As between all rights filed <br />in the same calendar year, priorities shall be determined by historical date of <br />appropriation and not affected by the date of entry of ruling.
