SEP 13 '004 DISTRICT COURT, WATER DIVISION NO.6, STATE OF COLORADO Case No. 81CW306 , :...,; RULING OF REFEREE, JUDGMENT AND DECREE '!', CONCERNING THE APPLICATION FOR WATER RIGHTS OF THE COLORADO WATER CONSERVATION BOARD ON BEHALF OF THE PEOPLE OF THE STATE OF COLORADO IN SOUTH FORK MICHIGAN RIVER, A NATURAL STREAM IN THE WATERSHED OF THE NORTH PLATTE IN JACKSON COUNTY THIS MATTER, having come on before the court on the appli- cation of the Colorado Water Conservation Board and the court be- ing fully advised as'to the matter of the application herein, hereby makes the following findings: The application herein was filed with the water clerk, Wa- ter Division 6, on December 21. 1981. All notices required by law of the filing of this application have been fulfilled, and the court has jurisdiction over the application. Statements of opposition were filed with the water court by the City of Fort Collins and the Water Supply and Storage Compa- ny. These statements of opposition have since been withdrawn. The Jackson County Water Conservancy District filed a statement of opposition and a protest to the ruling of the refer- ee which was entered herein on July 19, 1982. The conservancy district withdraws its protest by approval of this decree. A stipulation has been reached between the conservancy district and the board, a copy of which is attached hereto as exhibit A, and is made part of and incorporated into this order and decree. The relevant terms of the stipulation are as follows: .- 1. Applicant agrees to subordinate the water rights herein to any water right for irrigation or for storage for irrigation use so long as said water right continues to be ....,..~.
