The applicant <br /> <br />cites S 37-92-102(3) and S 37-92-10~(3), (4), and (10) <br /> <br />as authority for such claim of watet right. Said <br /> <br />statutory authority is in violation of art. XVI, S 5 <br />and art. XVI, S 6 of the Colorado Constitution. The <br />cited sections of the Constitution do not permit the <br /> <br />appropriation of water solely for the maintenance of <br />minimum levels of stream flow. <br />
